Our terms and conditions have been created to ensure your experience with our nursing services is as transparent and clear as possible. This document outlines key information regarding care appointments, payments, cancellations, liability, privacy, and more. By using our home nursing services, you agree to these terms.
1. Scope of Application
1.1. These terms and conditions apply to all care agreements, service requests, and services provided by Fermeira Care.
1.2. By using our services, you acknowledge and accept these terms and conditions.
2. Services and Fees
2.1. Fermeira Care provides professional home nursing and related care services tailored to the client's needs.
2.2. Fees depend on the type of care provided and any reimbursements from health insurers or mutualities.
2.3. Clients are informed in advance of any out-of-pocket costs.
3. Appointments and Cancellations
3.1. Care appointments are scheduled in consultation with the client or their representative.
3.2. Appointments must be cancelled at least 24 hours in advance.
3.3. Missed or late cancellations may be charged unless caused by force majeure.
4. Payment
4.1. If care is (partially) reimbursed by a health insurer or mutuality, billing will be handled directly with them.
4.2. For non-reimbursed care, clients will receive an invoice payable within 14 days of the invoice date.
4.3. Late payments may be subject to an administrative fee.
5. Liability
5.1. Fermeira Care is not liable for any damages resulting from incorrect or incomplete information provided by the client.
5.2. Our liability is limited to direct damages caused by proven negligence of our staff, and only up to the amount billed for the specific service.
5.3. We are not liable for indirect damages, including consequential damage, loss of income, or emotional distress.
6. Complaints
6.1. Complaints about our services must be reported within a reasonable time after discovery via admin@fermeiracare.com
6.2. We aim to respond to every complaint within five working days and to find an appropriate solution.
7. Privacy
7.1. Fermeira Care respects your privacy and processes personal data in accordance with the General Data Protection Regulation (GDPR).

8. Intellectual Property
8.1. All content on our website, including texts, images, and logos, is the property of Fermeira Care and may not be copied or distributed without written permission.
9. Governing Law and Disputes
9.1. These terms and all agreements are governed by Belgian law.
9.2. Any disputes shall be submitted to the competent court in the judicial district where Fermeira Care is located.
